TERMS & CONDITIONS OF SHORT TERM HIRE

Conditions applying to Short Term Hire

  1. Positive Systems as owner will invoice the hirer
  2. Positive Systems will provide hardware support on 0800 88 88 47 or 021 0706233
  3. It will be the hirer’s responsibility to ensure the unit is kept secure and free from damage.
  4. Positive Systems accepts no responsibility for lack of cellular coverage or Eftpos network congestion.  No refund will be given in these instances.
  5. The merchant (hirer) must keep all receipts.
  6. Positive Systems will not be liable for any lost sale or EFTPOS transactions.
  7. Hire periods allow one day each way for courier time unless otherwise arranged. The hirer will be charged $35 + GST for each day or part there of that the terminal is late.
  8. The hirer is required to return the terminal to 63 Ruakaka Beach Road, Ruakaka, Northland.
  9. Positive Systems in not responsible for any liability, claims, costs or expenses arising from damages or losses from the use or possession of its equipment.  The hirer shall use the equipment in a careful and proper manner and shall comply with and  conform to all municipal and other laws or ordinances and regulations in any way relating to the possession or use of the equipment.  The hirer shall not in any way alter or modify the equipment.  The equipment is rented without warranty or guarantee of any kind, expressed or implied.
  10. All pricing is in New Zealand Dollars and excludes GST and freight.
  11. All rentals are subject to equipment availability.
  12.  The equipment shall remain the sole and absolute property of the Owner and the hirer shall not sell, assign, pledge, underlet, lend or otherwise part with the possession of the equipment and shall not without the Owner’s written consent remove the equipment from the address set out overleaf and will protect the equipment from any distress, execution or seizure and indemnify the Owner against all losses costs damages and expenses incurred by the Owner by reason or respect thereof.
  13. The Subscriber understands that there is no agreement or arrangement entitling the Subscriber to buy the Equipment.

In the case that the hirer uses Positive Systems Merchant number, monies collect via the Eftpos machine will be transferred to the hirers nominated bank account within two working days after  the return of the equipment
